These Terms of Service govern your use of SailRouting. By accessing or using our website, our iOS or Android apps, or related services, you agree to these Terms. Please read them carefully, especially the safety notices and limitations of liability.
Introduction and scope
These Terms apply to the SailRouting website, the SailRouting mobile applications for iOS and Android, and the related online services and systems we operate (including servers that process routing requests and deliver results). Additional terms or policies shown in the product (for example at purchase) may also apply. If you do not agree to these Terms, you must not use SailRouting.
Eligibility and account
You must be legally able to enter into a binding contract under the laws that apply to you. You are responsible for all activity that occurs under your account and for keeping your login credentials secure. You agree to provide accurate account information and to update it when it changes. Notify us promptly if you suspect unauthorized access to your account.
Description of the service
SailRouting provides planning and decision-support tools to help sailors prepare maritime routes using weather, current, and boat-related information, delivered through our website and mobile apps. Available features and plans (such as Basic and Premium) are described in the product and may vary by platform or version. SailRouting does not provide official charting, real-time navigation, emergency response, or vessel traffic services on your behalf.
Important safety notice
SailRouting is a planning and decision-support tool only. It is not an official nautical charting service, a real-time navigation system, or a substitute for official charts, onboard instruments, notices to mariners, safety equipment, applicable regulations, or prudent seamanship. You must not use SailRouting as the sole basis for navigation at sea or for emergency decisions. You remain solely responsible for safe navigation, voyage planning, and compliance with all applicable rules.
Maps, weather data, currents, and routing results
Maps and overlays shown in SailRouting are for contextual illustration and planning. They are not official nautical charts and may omit, simplify, or misrepresent hazards, depths, restricted areas, and other information essential for safe navigation. Weather, current, and similar data, as well as routing results, are provided for informational and planning purposes only. Routing outputs are estimates based on forecast models, current data, boat settings, and performance assumptions you provide; real conditions may differ materially and change quickly. Always verify information using official publications, primary instruments, and independent sources before and during your voyage.
Acceptable use
You agree to use SailRouting only in compliance with these Terms and applicable law. Without limitation, you must not: • scrape, crawl, or systematically extract data from the service, or attempt to do so; • reverse engineer, decompile, or circumvent technical limitations or security measures, except where applicable law expressly permits; • interfere with or disrupt the service, overload our systems, or misuse APIs or automation beyond normal personal use of the product; • attempt to gain unauthorized access to accounts, data, or systems; • use the service for fraudulent, abusive, harassing, or unlawful purposes; • misuse subscriptions, trials, promotions, or account access (including sharing credentials in ways that violate these Terms). We may suspend or terminate access for violations.
Subscriptions, billing, and renewal
SailRouting may offer paid plans or subscriptions. Where and how you purchase determines who processes payment: • Website: subscriptions purchased on the SailRouting website are billed through our checkout flow (for example using Stripe) as shown when you complete payment. • iOS: subscriptions purchased in the SailRouting app on Apple devices are billed by Apple through the App Store. • Android: subscriptions purchased in the SailRouting app on Android devices are billed by Google through Google Play. Prices, billing cycles, taxes, and renewal terms are presented at purchase. Paid plans may renew automatically until you cancel in accordance with the channel where you bought the subscription. Apple’s and Google’s terms and policies apply to App Store and Play Store purchases, in addition to these Terms. SailRouting is responsible for providing the SailRouting service; the stores act as payment and distribution platforms for purchases made through them.
Cancellation and refunds
You can cancel as follows: • Website subscriptions: use the account or subscription management options we provide on sailrouting.com (or as described in your purchase confirmation). • iOS subscriptions: use your Apple ID subscription settings in accordance with Apple’s procedures. • Android subscriptions: use Google Play’s subscription management in accordance with Google’s procedures. Cancellation generally takes effect at the end of the current billing period, and you typically keep access until that period ends unless stated otherwise at purchase. Refunds: for purchases through Apple or Google, refund requests and eligibility are governed by the applicable platform’s policies and processes. For purchases on the SailRouting website, any refunds are handled according to the terms shown at checkout, our applicable communications, and mandatory consumer law where it applies. Nothing in this section limits non-waivable rights you may have under applicable law.
Service availability and changes
We aim to keep SailRouting available, but we do not guarantee uninterrupted or error-free operation. We may change, suspend, or discontinue features or the service (in whole or in part) for maintenance, security, legal, capacity, or product reasons. Where reasonable, we may give notice of material changes (for example on this page, by email, or in the product). Your continued use after updates take effect may constitute acceptance, except where applicable law requires a different process. During periods of high demand, certain features (such as routing priority) may differ between plans, as described in the product.
Intellectual property
SailRouting, including its name, branding, software, designs, text, graphics, and other materials, is owned by Emeraude Dev or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable right to access and use the service as permitted by these Terms. Any other use requires our prior written consent.
Privacy
Our Privacy Policy describes how we collect and use personal data. It is part of these Terms by reference. Please read the Privacy Policy on this website; it applies to the same SailRouting website, mobile apps, and related services covered by these Terms.
Suspension and termination
We may suspend or terminate your access to SailRouting if you materially breach these Terms, misuse the service, create legal or security risk, or fail to pay amounts due (where payment applies). You may stop using the service at any time. Provisions that should reasonably survive (including safety disclaimers, intellectual property, governing law, and limitations of liability where enforceable) remain in effect after termination.
Disclaimer of warranties
To the fullest extent permitted by applicable law, SailRouting is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, reliability, or non-infringement. We do not warrant that the service will meet your requirements, be uninterrupted, secure, or free of errors, or that routing results, maps, weather, or current data will be accurate or suitable for any voyage. Some jurisdictions do not allow certain disclaimers; in those cases, disclaimers apply only to the extent permitted by law.
Limitation of liability
To the fullest extent permitted by applicable law, Emeraude Dev and its affiliates, directors, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of or inability to use SailRouting, or from reliance on any output of the service. To the fullest extent permitted by applicable law, our aggregate liability for claims arising out of or relating to the service in any twelve-month period is limited to the greater of (a) the amounts you paid to SailRouting for the service during that period, or (b) zero if you did not pay for the service in that period—except where liability cannot be limited under mandatory law (for example in the case of death or personal injury caused by negligence where such limitations are prohibited). Maritime activities involve inherent risks; you use SailRouting at your own risk.
Third-party platforms
If you download or use SailRouting from the Apple App Store or Google Play, the applicable store provider’s rules for distribution, billing, updates, and refunds may apply in addition to these Terms. Apple and Google are third-party beneficiaries of any terms required by their store rules solely to the extent needed to enforce those rules. Except as required by those rules, Apple and Google are not responsible for the SailRouting service or its content. Questions about store billing or refunds should be directed to the relevant platform when your purchase was made there.
Governing law and jurisdiction
These Terms are governed by French law. Subject to mandatory provisions of the law applicable to you as a consumer, the courts of France shall have exclusive jurisdiction over disputes arising from or relating to these Terms, after seeking an amicable resolution where reasonable.
Changes to these Terms
We may update these Terms from time to time. The current version will be posted on this page, and we may update the “Last updated” date below. For material changes, we may also notify you by email or through the product where appropriate. Last updated: 24 March 2026.
